Service Policy

1. Basic concepts 

AMERISHOP is an intermediary for shopping in US online stores that helps you purchase and receive the products you want. AMERISHOP is not an online store or manufacturer, so all questions related to product quality and product warranty, return or exchange should be addressed to the seller directly. AMERISHOP does not determine the price of the goods or the taxes related to the purchase. AMERISHOP is responsible for the order and delivery of selected goods. 

AMERISHOP services include: product purchasing, logistics, insurance, storage, repackaging, shipping, freight, customs, tax and consulting services including market and usage analysis, industry information and promotional recommendations.

Customer - natural person - AMERISHOP customer, intending to order or purchase goods or ordering, buying or using goods exclusively for personal, family, household and other needs not related to business activities, having submitted an Order on the AMERISHOP website.

Goods - any consumer goods intended for the personal use of a natural person and the circulation of which is not restricted by the laws of the country where the Sender or Recipient is located. The purposes of use of the goods are determined in accordance with the laws of the Recipient's country.

Shipment - goods, the delivery of which is carried out according to the Customer's order.

2. General provisions

2.1. The rules of the AMERISHOP website (hereinafter - the Rules) are a legally binding document that sets out the rights and obligations of the Parties.
2.2. AMERISHOP reserves the right to change, amend or supplement these Rules at any time. The Buyer is informed about changes in the Rules on the website of the electronic store. 

3. Conclusion of the purchase-sale contract

3.1. The purchase-sale agreement between the Buyer and the Seller is considered to be concluded when the Customer forms and submits an order for goods on the AMERISHOP website, and, after receiving the final price offer, makes the payment, having previously familiarized himself with these rules.

3.2. By submitting the Order, the Client agrees that the Agent may entrust the execution of the Agreement to a third party, while remaining responsible for its execution.

3.3. The customer expresses his consent and gives AMERISHOP the right to receive, store, process and transfer his personal data.

4. AMERISHOP Rights

4.1. In the event of important circumstances, AMERISHOP may temporarily or completely suspend the operation of the website without notifying the Buyer in advance.
4.2. If the Customer tries to harm the work, stability and security of the AMERISHOP website or violates his obligations, AMERISHOP has the right to limit or suspend his access to the AMERISHOP website without warning.

4.3. If it is not possible to buy and send the ordered Goods, AMERISHOP has the right to unilaterally cancel the specified goods from the Order, informing the Customer about this by e-mail at the address specified during registration and returning the funds within 3 working days. 

5. AMERISHOP's obligations

5.1. AMERISHOP undertakes to make it possible to use the services of the AMERISHOP website, the operating conditions of which are determined by these Rules.
5.2. AMERISHOP undertakes to provide the following services (hereinafter referred to as "Services"):

• Purchase of goods at the Customer's order from a foreign supplier at the price indicated on the website;
• Delivery of the Goods ordered by the customer by handing them over to the postal service and/or the carrier.

5.3. AMERISHOP undertakes to deliver the goods purchased by the Customer using the delivery method chosen by the Buyer, based on the conditions set by these Rules.
5.4. After the customer has used Rule 5.2. according to the right provided for in point AMERISHOP undertakes to return the money paid to the Customer within 5 (five) working days.

6. Customer Rights

6.1. The customer has the right to order goods on the AMERISHOP website in accordance with these Rules.
6.2. The Customer has the right to cancel the Agreement concluded on the AMERISHOP website by notifying the Seller in writing only if the ordered goods have not been purchased and shipped.

7. Customer obligations

7.1. The customer must pay for the ordered goods and accept them in accordance with the procedure provided for in these Rules.
7.2. If the Customer, during the delivery of the goods, refuses to accept the goods without valid reasons, upon AMERISHOP's request, the Customer must cover the costs of returning the goods. 

7.3. By using the AMERISHOP website, the customer confirms that he accepts these rules and must comply with them.

8. Prices and charges

8.1. AMERISHOP applies a brokerage service fee of 13% (calculated from the product price to sales tax).

8.2. Prices for international shipping from the US:

SHIPPING BY AIRPLANE - $6.00 / 0.5 kg

SHIPPING - $3.50 / 0.5 kg

Minimum weight 0.5 kg.

9. Ordering and payment of goods 

9.1. The customer independently submits the Order to AMERISHOP.

9.2. The characteristics of all goods sold are indicated in the description of each item on the Supplier's website. AMERISHOP is not responsible for the fact that the color, shape or other parameters of the goods in the online store may not correspond to the actual size, shape and color of the goods. 

9.3. When submitting an Order on the AMERISHOP website, the Customer fills in the electronic Product Order form and submits the completed Order. You can order only those Goods that are in the Supplier's warehouse at the time of ordering.

9.4. In order to place an order, the Customer must provide correct information, by entering personal data necessary for the fulfillment of the order: your name, surname, address where the goods will be delivered, telephone number and additional information that may be important for the delivery of the ordered goods. The buyer confirms that he has read these rules and confirms the order.

9.5. Payment can be made using Visa / MasterCard payment cards as well as Apple Pay and Google Pay. Payments are processed using stripe.com payment platform.

9.6. When placing the Order, the Customer must also pay the costs of delivery of the purchased Product from abroad. The delivery price will be calculated when placing the Order, after the User has provided all the necessary information.

10. Delivery of goods

10.1. When ordering goods, the buyer must indicate the exact place of delivery of the goods.
10.2. AMERISHOP delivers the goods to the Buyer in accordance with the terms specified in the product descriptions.
10.3. The preliminary delivery time of Goods purchased from abroad will be indicated at checkout. If you choose delivery of goods from the USA by plane, the delivery takes 3-7 days from the receipt of the goods from the Supplier in the USA. If you choose delivery of goods from the USA by ship, the delivery takes 4-6 weeks from the receipt of the goods from the Supplier in the USA.

10.4. AMERISHOP is not responsible for the actions of courier services and transport companies (express carriers) and cannot influence the speed of delivery. The delivery times shown on the website are approximate.

11. Return of goods

11.1. Since the Goods ordered by the Customer are purchased from a foreign Supplier and delivered to the Customer from abroad, the Goods cannot be exchanged or returned. An exception applies if the received goods do not match the order due to an AMERISHOP error.

11.2. A product of inappropriate quality, for which a foreign supplier has set a warranty period, can be returned if defects are found during the warranty period.

11.3. Each request to return the Goods is considered individually. In order to submit a return request, the Customer must confirm the occurrence of a warranty case by providing the following data: video of unpacking, detailed photos of detected defects and their description.

11.4. If the Customer agrees on the return of the Goods with a foreign supplier, the costs of delivering the goods from the Recipient to the supplier are paid separately. In this case, delivery costs are not refunded to the Customer.

11.5. The product cannot be accepted for return in the following cases:

• The buyer provides false information that the delivered Product does not meet the description and/or specified requirements and quality. In such situations, AMERISHOP may demand evidence of such discrepancy from the Customer.
• the order was actually delivered, but the Customer for some reason refuses to accept it, or does not pick it up on time and the order is sent back to the foreign supplier.
• The customer tries to return the Goods beyond the deadline specified in the return conditions of the foreign supplier.

11.11. After the foreign supplier approves the return, the Customer must return the received Product to the address specified in AMERISHOP.

11.12. The foreign supplier independently makes a decision on compensation (conditions and amount of refund).

11.13. If the foreign supplier decides to refuse to accept the Goods from the Customer, AMERISHOP does not compensate the Customer for the price of the goods.

11.14. If the Product is subject to an international warranty, which will be indicated in the Product description, in the event of a warranty case, the Customer must contact the warranty center in the country where the Product was received.
